KMUUN Account Usage Agreement

Welcome to registering and using your KMUUN account!

The KMUUN Account Usage Agreement (hereinafter referred to as “this Agreement”) is a contract between you and Chonel Industrial (Shanghai) Co., Ltd. and its affiliates (hereinafter collectively referred to as “KMUUN” or “we”) regarding the registration and use of the KMUUN account.

Before using KMUUN’s registration and usage services (hereinafter referred to as “this Service”), we strongly recommend that you carefully read and fully understand each clause of this Agreement, particularly those related to service fees, disclaimers or limitations of KMUUN’s liability, restrictions on your rights, dispute resolution, and applicable law. These clauses will be highlighted in bold to draw your attention.

By clicking to agree, registering, or using the KMUUN account, you are deemed to have read, understood, and agreed to this Agreement and to be bound by each of its terms. If you do not agree with this Agreement, you have the full and unconditional right to exit the Service.


1. Overview

1.1 KMUUN Account: A KMUUN account is the identifier authorized by KMUUN under this Agreement, enabling you to register, log in, or use related KMUUN services. It is a pass to KMUUN’s services.

1.2 Agreement Scope: The contents of this Agreement include related agreements, service statements, business rules, and announcement notifications that KMUUN may release for this Service (collectively referred to as “this Agreement”). Once published, these contents become an integral part of this Agreement, and you should comply with them. Additionally, when using any specific KMUUN services, you should carefully read and agree to be bound by the specific agreements and rules for those services.

1.3 Account Core Functions: Your KMUUN account provides access to various KMUUN products or services, enabling account registration, login security, identity verification, and family services for products such as KMUUN Portal, Cloud Services, Browser, KMUUN Community, and KMUUN terminal equipment, as well as services offered by affiliated partners. To offer a secure, convenient, and unified login experience when using KMUUN products or services, KMUUN enables automatic login on your account.

**1.4 KMUUN grants you a limited, non-exclusive, non-transferable, non-sublicensable, and free license (unless otherwise stated in this Agreement) to use this Service.


2. Account Usage Standards

2.1 Account Registration

2.1.1 You confirm that before independently registering and using a KMUUN account, you have full legal capacity as stipulated by the laws of the People’s Republic of China. If you lack such capacity, both you and your legal guardian shall bear all consequences in accordance with the law.

2.1.2 You warrant that all information submitted during registration (including but not limited to your mobile number and email) is true, accurate, legal, valid, and your own. Otherwise, you may not be able to use this Service or may face usage restrictions. You bear responsibility for any liabilities or losses arising from incomplete or inaccurate registration information. You should register with authentic identity information, and submitted account names, avatars, and other registration information must not contain illegal or improper content. KMUUN reserves the right to deny registration if any issues are found and to take corrective action, suspend, or terminate accounts if violations are discovered after registration.

2.1.3 If your information changes while using the KMUUN account, you must promptly update it. You may view and correct your information through the KMUUN account settings.


2.2 Account Usage

2.2.1 The KMUUN account is your credential for accessing our services. The ownership of the KMUUN account belongs to KMUUN; as the original applicant, you only possess the right to use the registered KMUUN account.

2.2.2 You are responsible for all activities conducted under your account (including signing online terms, publishing information, purchasing goods and services, and disclosing information).

2.2.3 Within the scope agreed in this Agreement, you are not permitted to maliciously register multiple accounts, and without KMUUN’s written consent, you may not transfer, lease, or sell your account or authorize another person to use it. KMUUN reserves the right to determine and handle any violations at its discretion and reserves the right to pursue legal action against violators.

2.2.4 Your KMUUN account is tied to your personal information and KMUUN’s commercial data and may only be used by you. Unauthorized direct or indirect access by a third party is invalid. If KMUUN determines, under its platform’s breach assessment procedures, that your account usage jeopardizes account or KMUUN security, it may restrict or terminate your access to the Service.

2.2.5 If you breach the above rules, KMUUN may take the following measures per relevant laws and regulations:

(1) If you violate relevant laws, KMUUN’s terms, or business rules, KMUUN may independently evaluate and take corrective actions, suspend, or terminate your KMUUN account use, and decide on account reinstatement.

(2) If KMUUN identifies you as not the original applicant of the account, it reserves the right to terminate usage without prior notice.

(3) If KMUUN restricts, suspends, or terminates your account use, any associated losses (e.g., interruption of communication, deletion of user data, etc.) shall be borne by you.

2.2.6 If you log in using a third-party account, it will be linked to your KMUUN account, and your subsequent activities will be governed by this Agreement.

2.3 Account Security and Management

2.3.1 Your KMUUN account includes a username and password, which you are responsible for setting and safeguarding. You can use your phone number or email and password to log into and use related KMUUN services. KMUUN will never proactively request your account password.

2.3.2 You should take measures to protect your account security, such as regularly updating your password.

2.3.3 If you are using a KMUUN account that you did not initially register or obtained through unauthorized channels, you must not use that account or perform any operations with it. Please promptly notify KMUUN or the original registrant of the account.

2.3.4 If you lose your account information due to personal reasons and need to retrieve it, please follow KMUUN’s account recovery process. Ensure that all information provided is legal, accurate, and valid. If the information provided is insufficient, KMUUN reserves the right to deny account recovery.

2.3.5 KMUUN is not liable for any losses related to your KMUUN account resulting from voluntarily disclosing information, third-party attacks, fraud, or lost devices. You should pursue redress through legal or administrative channels as appropriate.

2.4 Account Recovery

If a KMUUN account is unused for 24 months or is not accessed by any other authorized means, KMUUN reserves the right to terminate that account. You will no longer be able to use it to log in to related KMUUN services, and KMUUN reserves the right to delete all associated data and reclaim the account. In the case of pending transactions or balances, KMUUN will notify you through SMS or email to assist with any necessary actions.

2.5 Account Deactivation

2.5.1 If you wish to deactivate your KMUUN account, you may do so through [My Account – Password and Security] and complete the deactivation process as instructed.

2.5.2 After account deactivation, we will permanently delete all associated data (unless otherwise stipulated by law). You will not be able to recover any information, including data from KMUUN Mall, KMUUN Cloud, and access card data.

2.5.3 Before deactivating your account, please review this clause thoroughly. KMUUN and any third parties assume no liability for any consequences or losses from account deactivation.


3. Third-Party Services

3.1 If you use your KMUUN account to log in to third-party software or platforms independently operated by affiliated companies or partners (hereinafter “third-party service providers”), you must also comply with their user agreements and privacy policies.

3.2 KMUUN has no authority or obligation to control the content of products or services provided by third-party providers. KMUUN does not accept any liability for the loss of rights resulting from the use of third-party products or services.

3.3 When third-party providers collect user information or track user behavior, it is your responsibility to review the associated agreements or notifications. KMUUN is not liable for any resulting risks or losses, and you should resolve any disputes with the third-party provider.


4. User Rights and Obligations

4.1 To use this Service, you must have compatible devices (e.g., smartphone, tablet, computer) and maintain a data or WLAN connection. You are responsible for related costs.

4.2 When using this Service, you must comply with relevant laws, such as the Cybersecurity Law, the Regulations on Internet News Information Services, and other applicable laws of the People’s Republic of China. You agree not to use this Service for any illegal or improper activities, including but not limited to the following:

  • Uploading, displaying, posting, transmitting, or otherwise making available content that:
    • Opposes the basic principles of the Constitution;
    • Compromises national security, discloses state secrets, subverts the government, or threatens national unity;
    • Damages national honor or interests;
    • Incites ethnic hatred, discrimination, or disrupts ethnic unity;
    • Violates national religious policies or promotes cults or superstition;
    • Spreads rumors, disrupts social order, or undermines social stability;
    • Contains pornographic, gambling, violent, or criminal content;
    • Defames, insults, or infringes upon others’ rights;
    • Contains false, harmful, threatening, invasive, or otherwise objectionable content;
    • Violates any Chinese law or regulation.

4.2.2 The following activities are prohibited:

  • Unauthorized access to or use of any computer network resources;
  • Unauthorized deletion, modification, or addition to any network data or applications;
  • Intentionally spreading viruses or other harmful programs;
  • Engaging in any commercial activities or selling KMUUN’s intellectual property, such as virtual currency or items, without authorization;
  • Any actions that jeopardize network security.

4.3 You agree to indemnify and hold KMUUN and its partners harmless against any claims, demands, or losses (including legal fees) resulting from any breach of this Agreement. KMUUN reserves the right to take measures such as deleting posted content, suspending accounts, or seeking legal recourse for violations. KMUUN will cooperate with law enforcement when requested.

4.4 You are not permitted to copy, resell, or commercially exploit any part of this Service without authorization.

4.5 You are legally liable for all actions taken during your use of this Service. You agree to compensate KMUUN if it incurs penalties or damages as a result of your actions.


5. Disclaimer

5.1 This Service is provided on an “as-is” and “as available” basis. To the extent permitted by law, KMUUN disclaims all express or implied warranties.

5.2 KMUUN is not liable for any loss of access due to the following:

  • Service interruptions, delays, or other issues caused by hacking, viruses, illegal content, or government regulations;
  • Losses due to third-party technical issues;
  • Interruptions due to system maintenance or upgrades;
  • Force majeure events, such as natural disasters or terrorism;
  • Service interruptions, delays, or termination due to legal changes or government actions.

5.3 This Service is for personal use only, and KMUUN bears no responsibility for losses from unauthorized third-party access.

5.4 KMUUN is not liable for any loss due to third-party account linkage.

5.5 KMUUN may access, use, and disclose your information to comply with legal requirements.

5.6 KMUUN is not responsible for any personal information leaks caused by improper use.

5.7 KMUUN is not liable for damages resulting from user interactions on this Service, including risks of harassment, defamation, or financial loss.

5.8 User-generated content does not represent KMUUN’s views, and KMUUN assumes no responsibility for it.

5.9 KMUUN is not liable for any indirect, consequential, punitive, incidental, special, or exemplary damages arising from your use of this Service. KMUUN’s liability is limited to any fees paid to KMUUN during the effective period of this Agreement.

6. Intellectual Property

6.1 Content you publish using your KMUUN account on any platform must not infringe upon the intellectual property rights of third parties. Without prior written consent from the rightful owner, you may not upload, publish, modify, distribute, or copy any material protected by copyright, trademarks, or other proprietary rights. Upon receiving appropriate notice from a copyright holder or authorized representative, KMUUN will review and remove any content infringing on copyright.

6.2 You retain intellectual property rights to any original content you post, upload, or otherwise make available using your KMUUN account, including text, images, videos, and software. However, by posting or uploading this content, you grant KMUUN a non-exclusive, perpetual, irrevocable license to use, copy, and sublicense these rights.

6.3 Without prior written consent from KMUUN, you may not use KMUUN’s intellectual property. You agree to respect KMUUN’s intellectual property and refrain from using names or terms similar to KMUUN or its associated brands, such as “KMUUN,” “KMUUN Mall,” or “KMUUN Network,” for any business, merchant, service, or product purposes. If any of these violations result in damages to KMUUN, you agree to bear the full extent of these damages.


7. Amendments

7.1 Given the rapid development of internet-related technologies, markets, and business models, you agree that KMUUN reserves the right to periodically amend this Agreement and relevant rules in response to changes in Chinese law, internet development, company strategy, or business practices. The updated agreement and rules will take effect following a reasonable public notice period and will replace previous versions.

7.2 We will notify you of any new agreements, and you may review the latest terms on relevant service pages. If the amended terms significantly impact or limit your use of this Service, we will request your consent via pop-ups, prominent web notifications, or SMS. If you do not agree to the revised terms, please discontinue use immediately. Continuing to use your KMUUN account or individual KMUUN services will constitute acceptance of the revised Agreement.

7.3 In compliance with applicable laws, KMUUN reserves the right to retain, terminate, or suspend your KMUUN account usage at any time without prior notice.

7.4 If you infringe upon a third party’s copyright and KMUUN receives notification from the copyright owner or their legal representative, KMUUN reserves the right to terminate this Agreement.


8. Termination of Service

8.1 If you violate laws or any term in this Agreement, we reserve the right to suspend, restrict, or terminate your account usage and discontinue service.

8.2 KMUUN reserves the right to temporarily or permanently terminate KMUUN account services (or any part thereof) as needed, with reasonable notice. You are advised to back up all stored data and information in your account.

8.3 We may terminate KMUUN account services in response to legal requirements, judicial orders, or government mandates.

8.4 In cases of service termination as outlined above, we will strive to notify you via platform announcements, SMS, email, or other available means. However, we may suspend, restrict, or terminate your access to all or part of the Service immediately without prior notice under the following circumstances:

  • 8.4.1 If you violate or are likely to violate this Agreement;
  • 8.4.2 If you or someone on your behalf engages in fraudulent or illegal activities, or provides false or misleading information to KMUUN;
  • 8.4.3 In compliance with requests from law enforcement or government agencies;
  • 8.4.4 During urgent system or hardware maintenance or updates;
  • 8.4.5 Due to unforeseen technical, security, or business reasons.

8.5 If the content associated with your KMUUN account infringes on the intellectual property rights of a third party and KMUUN receives notification from the rights holder or their legal representative, KMUUN reserves the right to terminate this Agreement.


9. Personal Information Protection

9.1 Protecting user privacy and personal information security is KMUUN’s priority. We are committed to safeguarding your personal data and will not collect or use your information beyond what is necessary for service provision without your consent.

9.2 We will implement necessary security measures in compliance with relevant laws to protect your information. However, KMUUN cannot guarantee the security of third-party services. If you have concerns about data collected or managed by a third party, or if you wish to exercise your legal rights, you should contact the third party directly.

9.3 In addition to this Agreement’s specific provisions on personal data protection, please carefully review the KMUUN Account Privacy Policy to better safeguard your information.


10. Governing Law and Dispute Resolution

10.1 This Agreement is governed by the laws of the People’s Republic of China.

10.2 In the event of a dispute, the parties shall resolve it amicably through negotiation. If unresolved, the dispute shall be submitted to the People’s Court in Haidian District, Beijing. Where single-item terms conflict with this Agreement regarding jurisdiction, the single-item terms shall prevail within the scope of those terms.


11. Miscellaneous

11.1 Effective Date
This Agreement takes effect from the date you accept it and remains effective throughout your use of this Service until terminated per this Agreement. If you began using this Service before accepting this Agreement, it shall apply from your first use.

11.2 Notifications
You are required to provide valid contact information (e.g., email, mobile number) when registering a KMUUN account and to keep your contact details up to date. KMUUN may send notifications to any of your provided contacts, which may have significant implications for your rights and obligations.

11.3 Severability
If any provision of this Agreement is deemed void, invalid, or unenforceable, the remaining provisions shall continue to be binding and effective.

11.4 Transfer of Rights and Obligations
You may not transfer or assign your rights or obligations under this Agreement without prior written consent from KMUUN. Any unauthorized transfer or assignment will be considered invalid. For reasons of business expansion or changes in operating entities, KMUUN reserves the right to transfer or delegate its rights and obligations under this Agreement.
